Cayuga County District Attorney Jon Budelmann announced today that David F. McNamara was convicted of Murder in the Second Degree (Intentional Murder) upon his plea of guilty shortly before 3:00 pm on Thursday afternoon in Cayuga County Court (Hon. Mark H. Fandrich presiding). The 36-year-old defendant is accused of strangling or suffocating Katie Socci in her Swift Street, Auburn home on June 14, 2011, leaving the former couple’s then 18-month-old daughter alone while he buried Socci in a shallow grave on Dunning Avenue.Socci, a mother and nurse, was 29.McNamara is currently serving a five-year-long bid in the Great Meadow Correctional Facility in Comstock for an unrelated drug conviction. The defendant waived his appeal rights and will receive a sentence of 20 years to Life when he is sentenced on April 23, 2013 at 9:15 am. This sentence is on top of the two years he will have served (currently in the custody of the NYS DOCCS) since his arrest in June 2011.DA Budelmann commented after the guilty plea: “This case involved a very thorough investigation which amassed a mountain of evidence. We were prepared to move forward with the trial. The maximum sentence the defendant faced if found guilty by a jury after trial was 25 to life. The defendant has already served 2 years. It meant more to the victim’s family that the defendant admit his guilt and not put the family through a lengthy public trial, than him getting the additional 3 years. I certainly respect their wishes and thank them for the grace they have demonstrated throughout the ordeal.””I would be remiss if I did not comment on the fine investigation done by the Auburn Police Department, with the assistance of the New York State Police and the Cayuga County Sheriff’s Office. All of our thoughts and prayers go out to the victim’s surviving daughter Sydney and her entire family.” DAVID F.
