Prison term for mother charged with DWAI drugs

The Cayuga County District Attorney’s Office announced today that 29-year-old Michelle Andujar was sentenced to 5 concurrent terms of 1-3 years in prison in relation to a DWAI Drugs and Alcohol crash on April 17, 2013 in Auburn, NY in which 5 children were injured. Andujar had pled guilty to 5 counts of Aggravated Driving While Ability Impaired By Combined Influence Of Alcohol And Drugs With Child Passenger Age 15 Or Younger In The Vehicle, one count for each child in the vehicle. Andujar had been given a chance to deal with her drug addictions in Felony Drug Court pending sentencing and was unwilling to do what was necessary to stop abusing drugs and complete that program. Instead, she chose to be sentenced today to the prison term. In addition to the prison sentence, her driver’s license was revoked mandatory fines were imposed, Court surcharges and fees must be paid, and she must submit a DNA Sample for the State DNA Databank. The defendant’s children are currently in the custody of their fathers. District Attorney Budelmann said “This case is proof of how strong the addiction to drugs and alcohol can be. Michelle Andujar first endangered the lives of her own children and the children of her friend by driving while under the influence of both drugs and alcohol. She then compounded that behavior by failing to complete Felony Drug and Alcohol Treatment Court. ” “This woman has lost her job, her home, custody of her children, and now her freedom, because she was unwilling to do the hard work necessary to stay clean and sober.”BACKGROUND INFORMATIONOn April 17, 2013, Michelle Andujar was operating her vehicle east on Wall St. in the city of Auburn when she crossed the center portion of the roadway into the westbound lane, striking a parked SUV head on. The impact pushed the SUV into another car parked behind it. There was significant damage to the first two vehicles. Auburn Police Officers arrived on scene to find 5 injured children in Andujar’s vehicle. Three of the children were Andujar’s and the other two were the children of another woman who was an intoxicated passenger in the vehicle. The children, ranging in age from 2 years old to 10 years old were all unrestrained and suffered from various injuries. None of the injuries were life threatening and the children were all treated and released from Auburn Community Hospital. Toxicology testing showed that Andujar had been under the combined influence of alcohol (BAC .07%), Xanax, Zoloft and Klonopin at the time of the crash.
