DWI charge for Port Byron man after vehicle ends up in Tyre marsh

The Seneca Count Sheriffs Office Reports that on Tuesday around 3:58 pm, Sheriffs Deputies arrested Derek D. Swann, age 22 of 8356 W. Loop Road in Port Byron, for Driving While Intoxicated.

The arrest stems from a report of a vehicle off the road way and into the marsh on State Route 5 and 20 in the Town of Tyre around 3:46 pm. The investigation determined that Swann was operating a 2011 Chevy Silverado west on 5 and 20 when the vehicle veered off the roadway and came to rest in the Marsh.

Swann was arrested for Driving While Intoxicated .08% or greater, DWI, Speed Not Reasonable and Prudent, Failure to Maintain Lane, Operating with a Open Container of Alcohol. Swann is to appear in the Tyre Town Court on the 13th of December 2016 at 5:00 pm.

The Town of Seneca Falls Police assisted with the investigation.
