Deputies: Victor man charged with DWI had BAC three-times legal limit

A Macedon man is facing multiple charges, including felony DWI after an accident in Victor earlier this week.

Deputies arrested Kevin P. Gallivan, 52, of Macedon for felony driving while intoxicated after a single-car property damage crash on School St. in the Town of Victor on Monday.

Deputies say Gallivan was attempting to make a u-turn on School St. when he backed off the roadway into the grass. He was uninjured, and submitted to a Datamaster test, which revealed he had a blood-alcohol content more than three times the legal limit.

Gallivan was issued a citation for driving while intoxicated, which became a felony due to a previous conviction in the last 10 years. He was also cited for driving without an interlock device and driving on a conditional license.

The charges will be answered at a later date in Victor Town Court.
