Cayuga man w/ 2 DWI’s gets 3rd in Seneca Falls

On April 14, 2011 at approx. 3:07 AM the Seneca Falls Police arrested Joshua M. Remaley, age 26 of 7395 Baldwin Road Cayuga, NY 13034. Police observed a green Ford Contour traveling at a high rate of speed westbound on Fall Street. Police then stopped the vehicle in the parking lot of Eagle Auto where police then found Remaley to be the driver of the vehicle. While speaking with Remaley police observed two open beer containers and a marijuana cigarette sitting on the passenger floorboard of the vehicle. Remaley then stated to police that he does not have a driver’s license and that he is currently in the process of getting his license re-issued through DMV. Police then learned that Remaley was revoked due to two previous DWI and DWAI convictions back in 2003 and 2008.While on scene police then administered field sobriety tests to Remaley which Remaley then failed. Police then learned that Remaley and his front seat passenger were consuming alcoholic beverages while driving down the road. Remaley was then placed into custody and was then transported back to the police department.At the office Remaley then refused the chemical test three times. Remaley was then charged with Felony DWI, Felony AUO 1st, Unlawful Possession of Marijuana, Speed in Zone, Fail to Keep Right, Refusal to take Breath Test, Consumption of Alcohol in a Motor Vehicle, and Unlicensed Operator.Remaley was then arraigned at the Town of Junius Court where he was then committed to the Seneca County Correctional Facility in lieu of $2,500 cash bail or $5,000 ins bond. Remaley has a Felony Hearing set for April 19, 2011 at 7:00 PM at the Town of Junius Court. The front seat passenger of the vehicle, Kenneth M. Townsend, age 26 of 8318 High Street Port Byron, NY was also charged during this incident for Unlawful Possession of Marijuana and Consumption of Alcohol in a Motor Vehicle. Townsend was issued two appearance tickets and was released. Townsend has to appear at the Town ofSeneca Falls Court on April 21, 2011 at 10:00 AM to answer his charges.
