Arrest made in April Town of Fleming burglaries

Sheriff David Gould reports that the Cayuga County Sheriff’s Office has arrested one person in connection with two burglaries which occurred in the Town of Fleming back on April 8th 2009. On that date the Sheriff’s Office took reports of burglaries at the Pit Stop Convenience Store and E&V Energy both located at 5696 South St. Rd. Both buildings had been forcibly entered. Beer and cigarettes were stolen from the Pit Stop and a safe was stolen from E&V Energy. Periodically over the past two and a half years Detectives have followed up on leads and have conducted numerous interviews. As of 02/23/11 Sheriff’s Detectives had developed enough information to obtain a Warrant of Arrest for Charles J. “Buddy” Smith, age 34 formerly of the Montezuma area. A warrant was issued by the Town of Fleming Court. On 09/08/11 Smith was arrested in Panama City Florida in regard to a Grand Larceny which occurred there. Smith had been residing at 211 Costa Dr. #4 Panama City Fl. for a period of time. Smith was then extradited back to Cayuga County and arraigned in the Town of Fleming Court on 11/04/11 and remanded to the Cayuga County Jail in lieu of $25,000 cash or $50,000 bond. Smith has been charged with one count of Burglary in the third degree-felony, and one count of Petit Larceny-misdemeanor in connection with the Burglary at the Pit Stop. Although no charges have been filed in regard to the Burglary at E&V, Detectives are convinced that the two cases are related. Sheriff’s Detectives are continuing to pursue other leads in both cases and are confident that both cases will eventually be closed and that at least one other suspect will eventually be charged.
