The Wayne County Sheriff’s Office reports the arrest of a Marion man after an investigation into the violation of the New York State Corrections Law, as well as the Sex Offender registration Act.
Richard Schermerhorn, 54, is a registered level one sex offender in Wayne County and is charged with one count of failure to update his photograph as prescribed by state law.
As a level one sex offender, a person is required by law to update that information every three years within the original registration date.
Schermerhorn was also charged with one count of failure to verify his address with DCJS. A registered sex offender is required to verify his or her address with DCJS, within ten days of receipt of the DCJS verification form when it is received by the offender.
An investigation by Wayne County Sheriff’s Deputies began when WCSO Records Division was notified by the NYS Department of Criminal Justice Services of the failure to update the photograph, and failure to verify his address, as prescribed by the NYS Corrections Law.
As a result of the investigation, Richard Schermerhorn was arrested and charged with the Corrections Law violation of failure to update his photograph, a class E felony, and failure to verify his address with DCJS as required by law.
Richard Schermerhorn was charged and released on an appearance ticket and is scheduled to appear in the Town of Lyons Justice Court at a later date and time to answer the charge.
