Ruzicka, Garee cases delayed again

Assault and harassment charges against Seneca Falls Town Board member Thomas Ruzicka were delayed Friday for the fifth time.

And a felony charge of making a terrorist threat against John Garee of Seneca Falls was also postponed Friday, the third adjournment of that case.

Both postponements were at the request of special prosecutor David Mashewske, an assistant district attorney for Yates County. Mashewske was involved in a trial last week and asked for the delay.

The cases are now on the calendar of Waterloo Town Justice Christopher Folk for 1 p.m. Dec. 15. Both cases were transferred from Seneca Falls Town Court to Waterloo Town Court, and Mashewske was named special prosecutor by Seneca County District Attorney Barry Porsch.

Ruzicka, who lost his bid for re-election Nov. 7, faces second-degree harassment and third-degree assault charges for allegedly accosting fellow board member David DeLelys in a downtown Seneca Falls restaurant following a special board meeting May 5.
