New permits governing large livestock farms in New York being developed by the state Department of Environmental Conservation in response to a lawsuit over federal clean water rules will not affect Cayuga County.
The DEC recently unveiled a draft version of new permits for Concentrated Animal Feeding Operations, or CAFOs, developed in response to a ruling from the state Supreme Court that foundexisting permits violated the federal Clean Water Act.
The complaint centered around the fact that CWA CAFOs were required to develop nutrient management plans but were allowed to have those plans both developed and checked for compliance by private contractors instead of state experts. The groups also alleged the permits did not sufficiently ensure manure be kept out of surface water.
The new draft would require CWA CAFOs to submit their nutrient management plans for review and approval prior to implementation.
