A woman facing an opportunity to go to a treatment facility instead of prison lost her shot by not showing up in court for her sentencing.
Charlotte Simmons, 53, skipped out on her sentencing court appearance, where if she had showed up, she could have reported to a treatment facility instead of serving time in jail.
Ontario County Court Judge William Kocher issued a bench warrant for Simmons, who during her previous arraignment was issued her enhancement warnings and told if she does not show up for her sentencing the deal was off and she would serve the maximum sentence.
Simmons is charged with third degree attempted burglary and criminal mischief. Based upon those charges she will serve the max sentence of two to four years in state prison.
